Limited Brokerage and Closing Services (for those who already have a buyer and seller))

  • Creating, sending and receiving properly signed, valid, enforceable contracts.
  • The use of our timeshare resale specific contract agreements that are 5 pages long and were created with a Real Estate Attorney to include all the legal items recommended to protect seller and buyer and satisfy the state laws and resort requirements.
  • Holding of Earnest Money deposit in a third party Broker's Trust account strictly regulated by the Division of Real Estate (optional)
  • Ensuring proper submittal of Right of First Refusal documentation. Advising clients should the resort chose to exercise. For seller, following up with Marriott to ensure terms of original agreement are met, sale is closed and Seller is paid. For Buyer, working to find a replacement timeshare if interested and seeing it through to closing.
  • Ensuring usage of the proper closing, title or legal services as required by state laws.
  • Discussing Title Insurance options and benefits with Buyer.
  • Access to our competent, experienced closing/title company affiliations. We work with different companies to close different Marriott properties based on location, state law and proven closing competency.
  • Use of third party closing company to hold all purchase funds in an escrow account until sale is recorded, closed and transferred with Marriott.
  • Coordinating between Closing/Title Services, Marriott Resale Department, Seller and Buyer to keep everything moving as smoothly and timely as possible.
  • Ensuring terms such as usage start date, maintenance fee responsibility and any reservations are transferred properly as per contract between buyer and seller.
  • Working with Seller, Buyer and Marriott on any issues that surface.
  • Deed preparation utilizing licensed attorneys and title companies, final closing documents for Seller and Buyer
  • Ensuring title/closing company receives correctly recorded deed from recorder's office and sends to Marriott for transfer
  • Ensuring confirmation of correct transfer with Marriott and disbursement of final funds to Seller.

Closing Services Only (for the do-it-yourself guru who already has a buyer, signed contracts and just needs a little bit of help)

  • Order resort written waiver, right of first refusal and confirmation of unit details, usage availability, amount due to pay account current, any delinquencies on account. Including faxes and phone calls to resort.
  • Coordinate ordering title search and policy, ordering of any loan payoff demands, including Priority mailing deed for recording and loan payoff check at closing. Prepare transfer documents for Seller and Buyer including deed, closing instructions, closing statements, tax forms, etc
  • Process trust accounting for Buyer deposit (you may send us credit card authorization or a personal check for opening deposits only). Closing funds must be via cashiers check or bank wire, since we cannot send a deed out for recording without good funds. We will disburse all checks at close of transaction, after verification of recording is received, as applicable.
  • Resort notification of change of ownership at close of transaction - we provide resort with a form to complete and fax back to us when buyer has been updated in the system.
  • Follow up phone calls, faxes, emails as needed throughout transaction.
  • Prepare any required affidavits, i.e. affidavit of death (additional fee applies), quitclaim, change of ownership reports, etc.

  • NOTE: This does not include resort transfer fee, documentary transfer tax and recording fees charged by the county recorder, or title insurance, which varies depending upon which title company issues for a particular resort or state.
